ProBiddr LLC ("ProBiddr," "we," "us," or "our") operates the ProBiddr marketplace platform, including the website at probiddr.com, the ProBiddr mobile application, and related services (collectively, the "Platform"). This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you access or use our Platform.
By creating an account or using the Platform, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with our practices, please do not use the Platform.
1. Information We Collect
1.1 Information You Provide Directly
We collect information you voluntarily provide when creating an account, posting jobs, submitting bids, or communicating through the Platform.

1.2 Information Collected Automatically
When you access the Platform, we automatically collect certain technical and usage information, including:
- Device type, operating system, browser type and version
- IP address and approximate geolocation
- Pages viewed, features used, links clicked, and time spent on the Platform
- Referring URL and search terms that led you to the Platform
- App crash reports and performance data
1.3 Location Information
We collect location information in the following ways:
- Property addresses provided by homeowners when posting jobs
- Service area provided by contractors during profile setup
- GPS data from contractor mobile devices during active jobs for check-in verification (only when the contractor explicitly initiates a check-in; we do not continuously track location)
- Approximate location derived from IP address
1.4 Information from Third Parties
We may receive information from third-party services you use to sign in (Google, Apple), background check providers (Checkr), payment processors (Stripe), and state licensing boards used to verify trade licenses.
2. How We Use Your Information
We use the information we collect for the following purposes:
- Platform Operations: Creating and managing accounts, facilitating job postings and bid submissions, processing token purchases, managing escrow payments, and enabling communication between homeowners and contractors
- Verification: Verifying contractor trade licenses against state licensing boards, processing background checks through Checkr, verifying insurance coverage, and confirming identity through Stripe Connect
- Trust & Safety: Detecting and preventing fraud, abuse, and unauthorized access; enforcing our Terms of Service; resolving disputes between users
- GPS Check-In: Verifying contractor arrival at job sites using geofenced GPS coordinates (only during active jobs when explicitly initiated by the contractor)
- Communications: Sending transactional notifications (bid updates, escrow status, payment confirmations), account alerts (license/insurance expiration reminders), and Platform updates
- Improvement: Analyzing usage patterns to improve Platform features, fix bugs, and enhance user experience
- Legal Compliance: Meeting tax reporting obligations (1099-NEC issuance), responding to legal requests, and complying with applicable laws
3. How We Share Your Information
3.1 With Other Platform Users
Certain information is shared between users as part of normal Platform operations:
- Homeowners can see: Contractor name, profile photo, trade, license level (but not full license number), verification badges (Licensed, Insured, Background Checked), bio, specialties, ratings, reviews, portfolio, availability, and service area
- Contractors can see: Homeowner first name, profile photo (if provided), job descriptions, property city/neighborhood (full address shared only after bid acceptance), and review history
- After bid acceptance: Full property address, phone number (if homeowner opts in), and direct messaging are enabled between the matched homeowner and contractor
3.2 With Service Providers
We share information with trusted third-party service providers who perform services on our behalf. See Section 4 for details.
3.3 For Legal Reasons
We may disclose your information if required by law, subpoena, court order, or governmental regulation, or if we believe disclosure is necessary to protect our rights, your safety, or the safety of others, investigate fraud, or respond to a government request.
3.4 Business Transfers
If ProBiddr is involved in a merger, acquisition, asset sale, or bankruptcy, your personal information may be transferred as part of that transaction. We will notify you via email and/or prominent notice on the Platform before your information becomes subject to a different privacy policy.
3.5 With Your Consent
We may share your information for purposes not described in this Privacy Policy with your explicit consent.
4. Third-Party Services
We integrate with the following third-party services to operate the Platform:

These service providers are contractually obligated to use your information only for the purposes we specify and in accordance with applicable data protection laws. We do not sell your personal information to any third party.
5. Data Retention
We retain your personal information for as long as your account is active or as needed to provide the Platform services. Specific retention periods include:
- Account data: Retained while your account is active and for 30 days after deletion request to allow for reactivation
- Transaction records: Retained for 7 years after the transaction for tax reporting and legal compliance (IRS requirements for 1099-NEC records)
- Escrow and payment records: Retained for 7 years per financial record-keeping requirements
- Messages between users: Retained for 3 years after the associated job is completed or canceled
- GPS check-in data: Retained for 1 year after the associated job is completed
- Background check results: The clear/flagged status is retained while the contractor account is active. Full reports are not stored by ProBiddr.
- Server logs and analytics: Retained for 12 months
After the applicable retention period, data is permanently deleted or anonymized so it can no longer be associated with you.
6. Data Security
We implement industry-standard technical and organizational measures to protect your personal information, including:
- Encryption in transit (TLS 1.3) and at rest (AES-256)
- PCI DSS Level 1 compliance for payment processing (through Stripe)
- Secure hashing for passwords (bcrypt)
- Two-factor authentication (SMS or authenticator app)
- Role-based access controls for internal systems
- Regular security audits and vulnerability assessments
- Automatic session expiration and device management
While we strive to protect your information, no method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee absolute security but are committed to promptly notifying affected users and applicable authorities in the event of a data breach, as required by applicable law.
7. Cookies & Tracking Technologies
We use cookies and similar technologies for the following purposes:
- Essential cookies: Required for login sessions, security tokens, and core Platform functionality. These cannot be disabled.
- Functional cookies: Remember your preferences, such as language and notification settings
- Analytics cookies: Help us understand how users interact with the Platform, which features are used most, and where users experience issues. We use [Google Analytics / Plausible / similar] for this purpose.
We do not use advertising cookies or share your data with ad networks. ProBiddr does not serve ads and does not sell your browsing data.
You can manage cookie preferences through your browser settings. Disabling essential cookies may prevent you from using certain Platform features.
8. Your Rights & Choices
Depending on your location, you may have the following rights regarding your personal information:
- Access: Request a copy of the personal information we hold about you
- Correction: Request correction of inaccurate or incomplete information
- Deletion: Request deletion of your account and personal information (subject to retention requirements in Section 5)
- Portability: Request a machine-readable export of your personal data
- Opt-out of communications: Unsubscribe from marketing emails at any time (transactional notifications required for Platform operation cannot be disabled while your account is active)
- Notification preferences: Control push, email, and SMS notification settings from your account settings page

9. State-Specific Privacy Rights
9.1 California Residents (CCPA/CPRA)
If you are a California resident, you have the right to know what personal information we collect, request its deletion, opt out of the sale of your information (we do not sell personal information), and not be discriminated against for exercising your privacy rights. To submit a request, email privacy@probiddr.com with the subject line "CCPA Request."
9.2 South Carolina Residents
ProBiddr LLC is organized under the laws of South Carolina. South Carolina residents may exercise their rights under applicable state privacy laws by contacting us at privacy@probiddr.com.
9.3 Texas Residents (TDPSA)
If you are a Texas resident, you have rights under the Texas Data Privacy and Security Act, including the right to access, correct, delete, and obtain a copy of your personal data, and to opt out of targeted advertising and the sale of your data. We do not sell personal data or engage in targeted advertising. To submit a request, email privacy@probiddr.com.
9.4 Other States
Residents of other states with applicable privacy laws (including Virginia, Colorado, Connecticut, and others) may exercise their rights by contacting us at the email above. We will process requests in accordance with applicable law.
10. Children's Privacy
The Platform is not intended for use by anyone under the age of 18. We do not knowingly collect personal information from minors. If we learn that we have collected personal information from a child under 18, we will promptly delete it. If you believe a minor has provided us with personal information, please contact us at privacy@probiddr.com.
11. Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or applicable laws. When we make material changes, we will notify you by email, in-app notification, or a prominent notice on the Platform at least 30 days before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated policy.
